By accessing or using our website, booking a tour, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Please read these Terms carefully as they contain important information about your legal rights, remedies, and obligations. These Terms constitute a legally binding agreement between you and Hazel Byline.

Definitions

  • "Booking" refers to a reservation of travel services made through our website, by telephone, email, or in person.
  • "Customer," "you," or "your" refers to the person who makes a Booking or uses our services.
  • "Deposit" refers to an initial payment made to secure a Booking.
  • "Itinerary" refers to the planned route and details of a tour or travel package.
  • "Tour" refers to a guided travel experience arranged by Hazel Byline.
  • "Travel Documents" refers to tickets, vouchers, itineraries, and any other documents issued by us or our suppliers relating to your Booking.

Use of Our Website

You may use our website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the website in any way that violates applicable laws or regulations
  • Use the website to transmit or send unsolicited or unauthorized advertising or promotional material
  • Attempt to gain unauthorized access to any part of the website
  • Use data mining, robots, or similar data gathering and extraction methods
  • Interfere with the proper working of the website

The content on our website is provided for general information purposes only. While we make reasonable efforts to update the information on our website, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the website or the information contained on it.

Bookings and Payments

Making a Booking

By making a Booking with us, you warrant that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are making a Booking on behalf of others, you warrant that you have the authority to bind all members of your party to these Terms.

A Booking is confirmed only when we issue a booking confirmation and receive the required deposit or full payment. Until these conditions are met, your Booking is not confirmed.

Pricing and Payment

All prices are quoted in the currency specified at the time of Booking and are subject to availability. Prices may change due to factors beyond our control, such as currency fluctuations, changes in taxes or fees, or supplier increases. If the price increases by more than 10% of the total tour cost after you have made a Booking but before your departure date, you have the right to cancel and receive a full refund.

Payment terms:

  • A non-refundable deposit of 25% of the total tour cost is required at the time of Booking
  • The remaining balance is due 60 days before the departure date
  • For Bookings made within 60 days of the departure date, full payment is required at the time of Booking
  • Payment can be made by credit card, bank transfer, or other methods specified by us

Booking Changes and Transfers

If you wish to change any part of your Booking after it has been confirmed, we will make reasonable efforts to accommodate your request but cannot guarantee that changes will be possible. Any changes are subject to availability and may incur additional charges.

You may transfer your Booking to another person who satisfies all the conditions applicable to the Booking, provided you notify us at least 30 days before the departure date. Both you and the transferee remain jointly and severally liable for the payment of any balance due and for any additional fees, charges, or other costs arising from the transfer.

Cancellations and Refunds

Cancellation by You

If you need to cancel your Booking, you must notify us in writing. Cancellation fees will apply based on when we receive your written notification:

  • More than 60 days before departure: Loss of deposit
  • 59-30 days before departure: 50% of total tour cost
  • 29-15 days before departure: 75% of total tour cost
  • 14 days or less before departure: 100% of total tour cost

No refunds will be given for unused services or portions of the tour not taken. We strongly recommend that you purchase comprehensive travel insurance that includes cancellation coverage.

Cancellation by Us

We reserve the right to cancel a tour for any reason, including but not limited to insufficient participation, force majeure events, or safety concerns. If we cancel a tour, you may choose between:

  • A full refund of all monies paid
  • An alternative tour of comparable standard, if available (if the price is lower, we will refund the difference; if higher, you will pay the difference)

We are not responsible for any incidental expenses or consequential losses that you may have incurred as a result of your booking, such as visa fees, vaccinations, non-refundable flights or rail tickets, or loss of enjoyment.

Tour Participation and Conduct

Health and Fitness

You must ensure that you are physically and mentally fit to participate in the tour. You should consult your doctor regarding any existing medical conditions and the destinations you intend to visit. You must disclose any pre-existing medical conditions or disabilities that might reasonably be expected to affect your participation in the tour.

We reserve the right to refuse a Booking or to remove a person from a tour if their condition or behavior is likely to affect the health, safety, comfort, or enjoyment of other participants or the smooth operation of the tour.

Travel Documents and Requirements

You are responsible for obtaining and maintaining all necessary travel documents, including but not limited to valid passports, visas, permits, and certificates. Your passport must be valid for at least six months beyond the duration of your trip. You are also responsible for understanding and complying with entry, exit, and health requirements for each country on your itinerary.

We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.

Tour Behavior

You agree to comply with the reasonable instructions of our tour leaders, guides, or other staff during the tour. You agree to behave in a manner that does not cause distress, danger, or annoyance to other tour participants or third parties.

We reserve the right to terminate your participation in a tour without refund if your behavior is deemed to be detrimental to the enjoyment of other participants, compromises safety, or violates local laws or customs.

Changes to Tours

We reserve the right to make changes to any aspect of the tour if necessary due to circumstances beyond our control or to improve the tour experience. Such changes may include but are not limited to:

  • Altering the itinerary, accommodations, or activities
  • Substituting services or facilities of a similar or higher standard
  • Changing the tour leader or guide

For minor changes, we will make reasonable efforts to inform you before your departure but are not obligated to do so.

For significant changes that materially alter the nature of the tour, we will notify you as soon as reasonably possible. In such cases, you may choose to:

  • Accept the changes
  • Book an alternative tour of comparable standard, if available
  • Cancel the tour and receive a full refund

Liability and Insurance

Our Liability

We will take reasonable care to ensure that the services we provide are delivered with reasonable skill and care. However, we are not responsible for:

  • Any act or omission of third parties, including but not limited to airlines, hotels, transportation providers, or other independent contractors
  • Any loss, damage, injury, illness, death, or expense due to circumstances beyond our reasonable control, including but not limited to force majeure events, political unrest, or acts of nature
  • Any loss of enjoyment or disappointment you may suffer due to circumstances outlined in your Booking or any circumstances beyond our control
  • Any services that do not form part of our contract with you, such as excursions or activities that you book independently during your tour

Our liability is limited to a maximum of three times the price of your travel arrangements. This limitation does not apply to cases involving death, personal injury, or damage caused intentionally or with negligence.

Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance that covers cancellation, medical expenses, repatriation, personal liability, and other risks associated with travel. We may require proof of adequate insurance coverage as a condition of your Booking.

It is your responsibility to ensure that your insurance policy covers all activities included in your tour, as well as any optional activities you may undertake during your trip.

Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By making a Booking with us, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy. This may include sharing your information with third-party service providers necessary to fulfill your Booking and provide you with travel services.

Intellectual Property

All content on our website, including but not limited to text, images, graphics, logos, icons, videos, and software, is the property of Hazel Byline or our content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, modify, distribute, republish, display, post, or transmit any content from our website without our prior written permission.

Reviews and User Content

By submitting reviews, comments, photos, or other content to our website or social media platforms, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that:

  • You own or control all rights to the content you submit
  • The content is accurate and not misleading
  • The use of your content will not violate these Terms or cause injury to any person or entity

We reserve the right to remove any content that we consider to be unlawful, offensive, defamatory, or otherwise inappropriate.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. The most current version will always be posted on our website with the "Last Updated" date. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms.

For material changes to these Terms that affect your existing Booking, we will make reasonable efforts to notify you directly.
